PODCAST: The Arbitration Paradox

This week on the Touro Law Review podcast we are joined by Professor Lisa Pomerantz and our first ever student moderator, Stephanie Stephenson. This discussion is centered around what Professor Pomerantz has termed, the “Arbitration Paradox.” The podcast commences with an overview of an article that Professor Pomerantz co-authored entitled Overcoming the Arbitration Paradox: Towards a More Collaborative Approach to Commercial Arbitration and a discussion on why this topic is so important. Professor Pomerantz explains some of the most significant amendments to the AAA Commercial Arbitration rules and how they may further empower future arbitrators to overcome the Arbitration “paradox.” The conversation concludes with some advice that Professor Pomerantz will give to attorneys on how they can overcome the Arbitration paradox.

Professor Lisa Pomerantz

Professor Lisa Pomerantz graduated from Harvard University and Boston University Law School. Upon her graduation from law school she clerked for a federal judge. After a stint as a litigation attorney, she worked for fifteen years as a senior-level in-house counsel for NEC.

Since 2003, Professor Pomerantz has practiced business and employment law on Long Island. She mediates and arbitrates commercial, consumer, and employment disputes for the American Arbitration Association. In addition she is on the mediation panel and the ADR Advisory Council for the United States District Court for the Eastern District of New York. She served in a variety of leadership roles with the Association for Conflict Resolution, the New York State Dispute Resolution Association, and the Suffolk County Bar Association.

Professor Pomerantz is a popular keynote speaker at legal and business meetings and conferences. She also publishes as email newsletter entitled, Making the Connection [Please find this newsletter on Professor Pomerantz’s website lisapom.com].  She has contributed numerous articles to the Suffolk Lawyer and ACResolution Magazine. She also has provided on-line and live training for business and legal audiences, and has taught at Touro University Law Center, New York Law School, the University of Tartu in Estonia and Vilnius University in Lithuania.

In her spare time, Lisa enjoys tennis, golf and duplicate bridge, and family get-togethers, including spirited doubles matches, with her husband Lance and sons Jeremy and Lionel.

Stephanie Stephenson

Stephanie Stephenson is a third-year student at Touro Law, where she is actively involved in various student activities. She is the President of the Alternative Dispute Resolution (ADR) Society, a Note Editor for Touro Law Review, Vice President of the Black Law Students Association (BLSA), andExecutive Co-director of the Legal Education Access Program (LEAP). Stephanie was a member of the Touro Mediation Team in the 2022 NYSBA Mediation Competition, where the team placed third after making it to the final rounds. After graduation, Stephanie will work for an NYC law firm practicing corporate law.
